The land is registered for Basic Payment purposes. 15.5 SDA entitlements are included in the sale, and will be transferred to the successful Buyer(s).

 

If the property is sold in Lots the entitlements will be apportioned as follows:

Lot 2 – 0.75 –  only if Buyer already has land registered for Basic Payment Scheme an makes a claim. (Minumum 5ha for registration).

The Buyer(s) will be required to comply with the terms of the Seller(s) BPS Application and will indemnify the Seller(s) of any breaches of the conditions of the application particularly in respect of cross compliance conditions.

The Seller undertakes to transfer the respective Basic Payment Entitlements to the Buyer(s) as and when the DEFRA/RPA rules allow, in accordance with the regulations of the Scheme. This transfer will be carried out by H&H Land and Property at a fee of £250 plus VAT, payable by the Buyer(s).

The Seller will make the 2016 claim and for the avoidance of doubt will retain the payment.
